Abstract
The study addresses the variation in the prices of state and interstate bus tickets as boarding approaches. It highlights constitutional values of the economic order, such as consumer protection and free enterprise, as well as the fact that public transportation is a social right, a second-generation human right. It examined the sources of law and conducted monthly consultations on the prices recorded on the digital platform queropassagem.com.br, always for the same companies and always for boarding on the same day, in order to highlight the conflict between free enterprise and consumer protection, as well as the importance of establishing proportionality between such prices.
