Abstract

The Psychiatric Reform through Law 10.216 / 01 was a redirect regarding the need to respect the human dignity of people with mental disorders. A second milestone came from the UN Convention on the Rights of Persons with Disabilities, ratified by Constitutional Amendment 45/2004, complementing protection against a minority who have historically suffered from exclusion. However, in 2019, the Brazilian government issued Technical Note No. 11/2019, which points out new treatments and paradigms to the National Mental Health Policy that came to concern health and law scholars regarding the return and re-pairing of the State in the use Electroconvulsive or Electroshock equipment, a risk to the dignity of the human person for people with mental disorders.
