Abstract
In Brazil, the law grants the right to special prison, among others, to those with a degree from a higher education institution. However, due to the precariousness of the prison system, in order for this benefit to be granted, a series of adjustments are required that impact even those inmates who do not have this right. This paper seeks to point out the differences between inmates with higher education and those considered as common prisoners by the prison system.
