Abstract

This article aims to analyze, in light of the prohibition of retrocession, the unconstitutionality of amendment no. 95/2016 for limiting government spending on health for a period of 20 years. In this regard, adopting the deductive method, the hypothesis is taken as a basis that the change in the normative text is unconstitutional because it violates the principle of prohibition of retrocession, which in the end had its validity confirmed.
