Abstract
Patient data, contained in electronic medical records, contain data that, if violated, can cause irreparable damage to both hospitals and patients in their personality rights. The Brazilian Law has instruments to effect the protection of data, with the purpose of making the protection of such data safer. It was concluded that the legislation is sufficient to safeguard and protect rights regarding data breach, but enforcement and control still need improvement.
