Abstract

This paper discusses the hypothesis that the phenomenon of the judicialization of health has been guiding public policies for controlling and combating diabetes in the State of São Paulo, and presents comparative studies on the effectiveness of insulin provided free of charge (NPH) and the most judicially required insulin (Glargine). The inductive method was used, starting from private data to a universal truth, and the research was qualitative, with bibliographic, normative and documentary technical procedures. In the end, it was found that it is not possible to state that the judicialization of health guides public health policies and that there is an imminent need to review official protocols to better treat the pathology in question, since the data demonstrated may be an indication that the policy to combat diabetes adopted by the federative entity is not being sufficient to reduce and control this disease.
