Abstract
This study aims to analyze Decree 9.759/2019, which determined the extinction of councils and collegiate bodies created by decrees, their effects on the National Council of Indigenous Policy (CNPI) and possible reflections that the extinction of this body can bring to the implementation of indigenous health as a right. Using the inductive method, it was verified that the extinction of councils undermines the Brazilian democracy; that the extinction of the CNPI impairs the realization of the right to indigenous health, and presents a paradox promoted by the Federal Executive, by promoting, in a single time, public policies that, in theory, would benefit the Indians and that harm them, preventing the effective realization of the constitutional determination to protect the health of all, including indigenous people.
