Individual Freedom and Undue State Interference on Family Planning Marcello Custódio Costa

Abstract

 This study aims to discuss individual freedom in family planning due to article 10, item I and § 5th, of Law nº 9.263/1996. Being so, bibliographical, legislative, documentary and electronic researches were conducted, finding that such legal provisions violate human dignity principle and individual freedom, as well as violate and limit the right to family planning, as set out in article 226, § 7th of the Federal Constitution of Brazil of 1998.
