Abstract

The objective of this work is to analyze the civil responsibility of the titular surgeon for harmful acts performed by members of the surgical team. It is also intended the analysis under the focus of the rules issued by the Federal Council of Medicine regarding the responsibilities of the head surgeon in choosing the medical team. It was found that the civil responsibility of the incumbent surgeon is closely related, in doctrine and jurisprudence, with the existence or not of autonomy of the member of the surgical team that caused the damage, however, little discussion is seen from the perspective of the resolutions of the class.
