Abstract

 The aim of this article is to analyze binding force of the Recommendation 24 of the Committee on the Elimination of All Forms of Discrimination against Women (CEDAW), which guides States Parties on women's right to health. The research method is narrative criticism, based on legislative and doctrinal analysis. Although the Recommendation proposes important guidelines for the implementation of public policies for women's health, it is not traditionally recognized as a primary source. However, it inherits the binding effect of the treaty and is closer to international custom, demonstrating the need to review the theory of sources in order to broaden the concept of primary source of international law.
