Abstract

 The Federal Constitution of 1988 established solidary federalism in the provision of health services, with common competence of the Union, the States, the Federal District and the Municipalities. This article addresses the financial impacts of the judicialization of health in Brazilian municipalities, highlighting that the intervention of the Judiciary in public policies compromises the municipal capacity to meet other demands and affects fiscal balance.
