Abstract

This article addresses assisted human reproduction for same-sex couples made up of people without a uterus, through the temporary transfer of a third person's uterus, analyzing the Resolutions of the Federal Council of Medicine (CFM), which regulates the practice by doctors who offer the treatment. The objective of the work was to analyze whether the imposed parental limitation violates the right to family planning of people who do not have family members available to carry out the voluntary transfer of the uterus, specifically when the couple has the opportunity to reproduce through a person who maintains a socio-affective relationship. . The result found reveals that the infralegal rule of the Federal Council of Medicine does not have the binding force to prevent same-sex couples without a uterus from using the uterus of a third person, even without any blood link, as long as it does not violate the law and remains free of charge. of the relationship.
