Exoneration from alimony due to the age of majority under the Brazilian system of judicial precedents
Main Article Content
Abstract
This study analyzes the application of the judicial precedents system in Brazil, with emphasis on the exoneration of alimony when the beneficiary reaches the age of majority. The objective is to understand how decisions of the STJ influence lower courts, promoting uniformity and legal certainty. Based on doctrinal analysis and jurisprudential research, the study is limited to the examination of decisions of the TJSP and the STJ, as well as the legal doctrine. The findings indicate that, although the age of majority is a relevant milestone, it does not automatically end the maintenance obligation, an analysis of the beneficiary’s financial self-sufficiency required. It is concluded that judicial precedents contribute to greater predictability in court decisions.
