Retirement for Transgender People: Challenges and Perspectives in Benefit Granting

Abstract
This article examines retirement for transgender people, whose gender identity differs from that assigned at birth and who have legally changed their gender. Although Article 5, Clause I, of the Brazilian Federal Constitution guarantees equality between men and women, the legal system does not yet fully include transgender individuals. Despite some advances, effective equality remains limited. Social security rights should be guaranteed based on equality, not sex-based distinctions. The article shows that, even with legal gender change, many essential rights for subsistence are still not ensured, using national and international data for comparative analysis.
