Dialogue between the existential minimum and civil disobedience

Abstract
This study aims to analyze the concept of the existential minimum and its relationship with civil disobedience. The methodology adopted was deductive, based on bibliographic research, with sources including legislation, legal scholarship, and the Federal Constitution. The findings reveal that citizens have faced significant obstacles in realizing their minimum rights, due to the State's failure to fulfill essential obligations. It is concluded that, as a consequence of this omission, the principle of exceptio non adimpleti contractus (the exception of an unfulfilled contract) becomes relevant.
