Abstract

The project addresses the functioning of legal abortion in Brazil, as well as Constitutional Rights and their effectiveness regarding this matter. Legal doctrines will serve as the basis to understand and discuss the intentions and performance of legislation within the Brazilian context. The purpose of this study is to analyze the effectiveness of the law governing abortion and to examine the challenges faced in its application. The research will be qualitative, employing the case study method. Data collection will rely on bibliographic and documentary research, focusing on official institutional documents, such as the 1988 Federal Constitution, the Penal Code, the Code of Criminal Procedure, reports, and jurisprudence
