Abstract
This article proposes to analyze the parental sickness benefit, a benefit not foreseen in the social security legislation and granted to the public servant of the Social Security Own Regime. In this context, the study was conducted through descriptive research with method of documentary analysis based on doctrine and jurisprudence in accordance with the Bill (PL) n. 1876/2015 [1] establishing parental sickness benefit to the insured of the General Social Security Regime and inserting Article 63-A into Law No. 8,213 of July 24, 1991 [2]. The results evidenced the urgency in the voting of the PL n. 1876/2015 [1] due to lack of legal predictability and deadlock in positioning by the judiciary.
