Abstract

This study aims to delimit the figures of the mandado de segurança, of Brazilian law, and of the writ of mandamus, of American law, presenting their major differences and similarities. It was found that, although they have intercessions, the figures are not confused. The main difference is in the exceptionality that US jurisprudence attributes to the writ.
