Abstract

Home-assisted reproduction, over the past few decades, has become a key tool for couples and individuals facing challenges in conceiving naturally, offering the hope of a family to those who once had no alternatives. This complex panorama highlights the need for a clear and harmonious understanding between institutions, guaranteeing rights, clarifying responsibilities and ensuring the integrity of the assisted reproduction process in the country. As a specific objective, we will analyze Provision 63/2017 of the National Council of Justice (CNJ) in relation to the guidelines and positions of the Federal Council of Medicine (CFM) and the National Health Surveillance Agency (ANVISA) on homemade assisted reproduction techniques and the recognition of double maternity. Provision 63/2017 of the CNJ, which establishes models of birth certificates for children generated by assisted reproduction techniques, has generated debates, especially with regard to compatibility and harmonization with the regulations of the CFM and ANVISA.
