Abstract
Port labor constitutes a fundamental activity within the scope of international trade, encompassing complex operations such as loading and unloading, storage, and the handling of goods. Within this framework, the establishment of the port hazard allowance by Law 4.860/1965 functions as a compensatory mechanism for workers exposed to adverse and potentially hazardous working conditions. Notwithstanding its relevance, the entitlement to said allowance is subject to specific legal criteria. This article examines the applicability of Brazilian Supreme Federal Court (STF) Topic 222, which provides a restrictive interpretation regarding the recognition of this right for port workers.
