Abstract

This article analyzes the normative power of regulatory agencies in Brazil, with an emphasis on ANTAQ, addressing its constitutional, legal, and jurisprudential foundations. It examines the technical autonomy of these entities to issue complementary rules in the regulation of strategic sectors, reinforcing transparency in regulatory impact, highlighting the risks of overstepping their competencies, and the need for control mechanisms, ensuring legal certainty in the public interest.
