Human Dignity and the Legislative Gap for Caregivers of Persons with Disabilities in Brazil

Abstract
This research analyzes the legal protection of persons with disabilities in Brazil and the gap within Social Security regarding caregivers. The objective is to identify the limits of Social Security and Social Assistance, highlighting the absence of specific legal support for caregivers under the Continuous Cash Benefit (BPC). The methodology adopted was a documental and bibliographic analysis of national and international norms, such as the 1988 Constitution and the UN Convention. The results show that, while Social Security grants an additional amount in disability retirement, Social Assistance remains silent, mainly affecting women caregivers. It is concluded that the lack of policies directed at caregivers undermines the realization of human dignity and social development.
