Abstract

The article aims to highlight that the application of the CDC to real estate development contracts is a matter established in Brazilian doctrine and courts; That there must be a dialogue between the sources of law (Consumer Defense Code, Real Estate Development Law and Brazilian Civil Code); That the exception of the unfulfilled contract (art. 476 and 477 of the CC) does not apply to adhesion contracts governed by the CDC.
