Abstract
This paper seeks to highlight the need for implementation of contingency and integrated management plans by the municipalities of the Coastal Zone, especially in de city of Santos, home to the largest port in Latin America, as well as seeks to assess the issue of municipal participation in the control of port activities through the territorial planning and its intervention in environmental licensing, for the protection of natural resources, especially the mangroves. The first part of the paper presents the guidelines of the sustainable management of the waterfront and its vital role in the preservation of their environmental, economic and social functions, as well as in reducing conflicts and irregular use of that space. Also highlights the seafront intervention plan as an instrument of coastal management and addresses the Orla Project as an important mechanism developed by the federal government to lead the development and implementation of municipal seafront intervention plan. Finish this first part of the paper a proposal for delimitation of the land strip to prepare the seafront intervention plan of the municipality of Santos, in view of the climate change issue and its impact on the rise in sea level. The second part of this paper deals with the issue of preservation of mangroves and their use for the installation of port activities, including private terminals. It also discusses the role of the coastal municipality in the environmental licensing activities, notably the port activities, both in relation to the receipt of financial compensation and in relation to its intervention in the licensing procedure: a) manifestation as a stakeholder; b) issuing of a non-binding technical opinion; c) evaluation of environmental impact studies; d) issuance of the certificate of regularity regarding de land use; e) predictability of rules and more stringent measures by the municipality in relation to land use and real estate utilization in the coastal zone.
