Abstract

The objective of this study is to demonstrate the applicability of the effect of loss of elective mandate due to criminal conviction to members of the National Congress, pointing out different understandings on the subject, in order to conclude whether it is the prerogative of the Legislative Branch to decide on the loss of elective mandate of Federal Deputies and Senators or whether it results from a criminal conviction handed down by the Supreme Federal Court, seeking harmony among the Powers of the Republic and the real meaning of the Federal Constitution as a unity.
