Abstract

One of the greatest challenges for civil liability in law is the quantification of moral damages due to their subjectivity. The sentences handed down by judges are usually insignificant compensations granted to victims to compensate for this damage. This obstacle was the main problem of this article and was dynamically resolved based on factual situations and in the most objective way possible through the institution of punitive damages, which is dealt with in both comparative law and Brazilian law.
