Abstract

Education, as a fundamental right guaranteed by the 1988 Federal Constitution, is a duty of the State to ensure it for all Brazilians. In this context, the National Education Plan was reformulated, establishing goals for the educational segment. Thus, the objective of this article is to make a critical analysis of the current PNE. Based on this analysis, the author of this article concluded that, although the PNE has been widely discussed, it is still far from guaranteeing education as a public social right. It was also found that the State, by using verbs in the aforementioned plan such as “incentivize” and “stimulate,” instead of “ensure,” may indicate tactics that relieve the State of its obligations.
