Abstract
Burnout Syndrome or professional exhaustion syndrome is one of the industrial damage of psychosocial nature of current society stems from a chronic labour and stress is related to emotional, physical and mental disorders, and risk factor for the organization of work. Characterized by being the peak of professional stress, can be found in any profession, but especially in jobs where there is a direct impact on the lives of other people. the present study aimed to understand the factors that contribute to the emergence of the burnout syndrome in workers, and harms, unhealthy workplace. to this end, developed a qualitative and descriptive research from: a) bibliographical research (books, national legal journals) and documentary (laws, court decisions, public advice manuals, regulatory norms) constituting specific aspects of the topic investigated; b) survey of litigation about the Burnout Syndrome discharged in the last 10 at the regional labor court of the 2nd region, São Paulo during the month of june 2018. The results showed that of the 49 cases studied, 29 were started by women, and 10 with decisions founded, and 19 with unfounded sentences. Men totaled 20 actions among the 49, where five decisions received and 15 had their requests denied. This research noted that women are more affected by SB, and the reasons pointed out, on the double shift, work and family. We can be concluded that the occupational disease Burnout Syndrome, as analyzed in this study, although increasingly affects the workers, your recognition in the world of work is precarious.
