Main Article Content
Abstract
This paper aims to address the effects of selectivity in the criminalization of drug trafficking and consumption, as provided for in Law 11,343 of 2006. The analysis was carried out based on the study of critical criminology by Alessandro Baratta, highlighting the four different types of control models spread throughout the world in the view of Luciana Boiteux. This paper presents the relevance of selectivity in the Brazilian legal system, and in return provides a critical understanding of which model is the most appropriate so that the most disadvantaged social classes do not suffer from the prejudice of prejudgment.
