Abstract

This article analyzes the evolution of Fundamental Rights and their relevance in the process of constructing Health Law. This claim is based on the identification and evolution of patient rights and their interrelation with social movements and non-governmental organizations. The core of the analysis is Advocacy and its role as a means of political intervention. The study seeks to determine whether this is, in fact, an efficient instrument that enables public policies. An explanatory methodology based on ideas and theoretical assumptions of other authors was used, in addition to a historical incursion on the subject. The result of this analysis was the identification of this institute as a practice used in political-social activism and in the praxis of civic organizations. Finally, it concludes that Advocacy is an effective means of pressure in the search for public health policies and in guaranteeing the fundamental rights of patients in the public and private systems.
