Abstract
This research discusses the existence of gender prevalence in the work environment. This is because, considering the principle of equality, there is no justification in contemporary times for the depreciation of the female gender in positions, vacancies to be competed for or management positions, in addition to the depreciation of reserves, given the existence of broad national and international legislative support that repudiates this practice. The objective of this academic work is to analyze the existing legislation and verify its applicability or not, since the lack of observance of gender equality reverberates in impacts on the mental and social health of the worker victimized by such behaviors, generating, as a consequence, absence due to occupational illness or a drop in productivity, in addition to animosities that reflect on social coexistence inside and outside the work environment designated for the provision of services. In this context, through the deductive methodology, supported by theoretical references published in physical and digital media, the results of the impacts on the gender prescription established especially between the male and female genders will be demonstrated, concluding, in the end, that the legislation allows the reprimand of discriminatory gender behavior, but its non-observance creates a social problem that is reflected inside and outside the work environment itself, implying in social problems that can affect the health of discriminated people.
