Abstract

Background: Over the last few decades, globalization has significantly transformed the global economic and political landscape, directly impacting the way social rights are perceived and applied. Problem: This study examines the challenges that globalization poses for the realization of the right to health, including the influence of global economic policies, inequality in access to health care, and the consequences of the COVID-19 pandemic. Objectives: This study aims to analyze the crisis in the realization of fundamental rights by the Brazilian State, especially the right to health, in view of the influence of the globalization process and neoliberal ideas. In addition, it considers strategies to mitigate the negative impacts of globalization on the right to health, such as the need for international cooperation and the promotion of equity. Methods: The qualitative method was used through a bibliographic review and scientific literature. Results: The research revealed that the influence of the State on economic activity directly impacts the promotion of social rights, highlighting the impacts of globalization, capitalism, and neoliberal ideas. A worrying reduction in social rights was identified, especially in access to health, accompanied by a significant increase in social inequality. Conclusion: The purpose was not to exhaust the topic, but to provoke reflection on the mitigation of social rights in Brazil, which leads to a crisis of the Democratic Rule of Law provided for in the Federal Constitution of 1988. It is concluded that the challenges are enormous and it is through the action of society, political awareness and the effective participation of the community that the quality and efficiency of the State's actions will be promoted.
