The right to socio-environmental health and the declaration of the rights of nature – Pacha Mama as a subject of rights
Main Article Content
Abstract
This work seeks to identify the factors that gave rise to the right to health and to proceed to relate it to the right to an ecologically balanced environment. The relationship between the two rights lies in the constitutional provisions of health and a healthy quality of life for all. The problem to be overcome is the need to integrate scientific evidence into the process of participatory democracy, as well as to overcome the representation of power before the people, making the representation of the people before power prevail. The bibliographic material was obtained in an exploratory manner and subsequently treated as a narrative review. The selection was made through authors who are references in Brazilian legal doctrine and non-legal documents. The social determinants of health characterize the field where these rights that guarantee life are found and, also, where evidence capable of declaring new rights is verified, such as the rights of nature – Pacha Mama as a subject of rights.
