CHANGES AND THE MODIFYING EFFECTS OF THE DECLARATIONS OF EMBARGOS IN THE NEW CPC Maria Angélica Cesar Vasques, Sandra Aparecida Sá dos Santos

Abstract

The Statement of Clarification provided for in Chapter V, Articles 535 to 538 of the 1973 Code of Civil Procedure underwent several modifications and gained more clauses and paragraphs in their articles in the 2015 Code of Civil Procedure. Before the new code came into force, the changes were already necessary, such as the modifying effects, which, even though not enshrined in the 1973 code, there are numerous case laws, making such effects a necessary reality in civil, labor, social security law, among others. Thus, these changes will be mainly addressed, especially the aforementioned modifying effects.
