THE TRANSFORMATION IN THE INQUISITORIAL NATURE OF THE POLICE INQUIRY IN FUNCTION OF LAW 13.245/2016 Fernada Pinheiro Azevedo

Abstract

This article addresses the issue of a possible change in the legal nature of the police investigation, caused by the advent of Law No. 13,245/2016, which amended art. 7 of the OAB Statute, granting a series of new rights and prerogatives to lawyers, in the interest of their clients, during the processing of the police investigation. Thus, by establishing these new prerogatives, the issue arises about a possible transformation in the inquisitorial nature of the preliminary investigation into an accusatory one, in order to guarantee, from the preliminary phase, the exercise, by the accused, of the adversarial system and full defense, as established by art. 5, LV of the CFRB.
