THE APPLICATION OF THE INSTITUTE OF DISREGARD OF INVERSE LEGAL PERSONALITY IN BRAZILIAN CIVIL PROCEDURAL LAW José Arnaldo Martins de Sales

Abstract

This article discusses the theory of disregard of the legal personality in the reverse mode in addition to the procedure and process adopted by the Civil Procedure Code. In this light, the work was divided into chapters and the approach on the subject made ​​step by step towards defended outcome. Comprehensiveness of the content included the brief examination of the Institute, through the concept of individual and corporate person, as well as the notion of the theory of autonomy. More forward, it is addressed specifically on the requirements or conditions for realization and admissibility of disregard, analyzing, still, as it has been applied to reverse disregard in Brazilian courts and, finally, the doctrinal position and jurisprudential ruling on the subject in I comment.
