Abstract
This article investigates the application of mediation and conciliation in cases of conflicts in the health area. Given the increasing incidence of conflicts in
health related to the effectiveness of individual and / or collective basic needs, the provision of public or private services, the emergence of seeking solutions to conflicts in this area is evident. Health is considered a fundamental right of individuals, guaranteed constitutionally, however, requires policies and instruments to protect human and social life, conditions in which they impute complexity in the legal treatment. A compilation research was carried out in scientific and juridical articles, as well as other publications and jurisprudences that address the descriptors: mediation, conciliation, law, health, conflicts. It is shown that mediation and conciliation are techniques that reflect in a management approach to health conflicts by establishing dialogue and non-violent communication as a way to realize health rights, guaranteeing the full care of the individual and access to health without need to resort to the legal area.
