Abstract

The present study aims to analyze the ICD-11 (International Code of Diseases) of the WHO (World Health Organization) from the point of view of the human rights of the intersex people, in the perspective of the proposals of modification and despatologization of sexual and gender minorities. The method will be the deductivedialectic, through reports of Human Rights in the international scope and foreign books related to the subject, as well as of the unique Brazilian bibliography. The hypotheses of the present research start from the triggering questions: Does the ICD-11 Code respect IRights? Are the sexual rights of intersex people respected within WHO? Is there pathologization of the intersex person? We propose solutions for the use of some pathologizing expressions and analyze, from the perspective of the IRights (Human Rights of the Intersex), the use of expressions and solutions for the existing cases, analyzing the most recent case of the Autralian Court, the case Re: Carla v. Australia, on "normalizing" surgeries, which perform genital mutilation. We propose to change the ICD-11 term "sexual development disorder" to "congenital variations of sexual characteristics" or "differences in sexual development", avoiding violation of the human right to dignity, freedom and self-determination.
