Abstract

Ximenes Lopes versus Brazil, international case of the Inter-American Court of Human Rights, was a great landmark for the Brazilian State, since it was its first conviction for the violation of Human Rights in its territory. The victim, who was mentally disabled and therefore vulnerable, was killed because of mistreatment and physical violence. Of all, it was also verified that the facilities of the psychiatric institution in which he was treated were highly inappropriate, reason why the mental
situation of the patients was vulgarized, violating their right to the progress. In this paper it is intended to verify in the light of the studied case how mental health impacts
on the quality of life and the social well-being of the right holders to life and peace. In addition, the present work seeks to identify how the recognition of Brazil's negligence
reflected in the psychiatric reforms established after the conviction before the Inter-American Court, and also, as a consequence, to understand if the mental health began
to be assimilated as a motive of quality and promotion by the institutions. For this analysis, international judgments, scientific texts, journalistic texts, resolutions of international organizations and doctrines were studied. The methodological approach
is the postmodern one, with the purpose of understanding the redefinition of paradigms originating from the responsibility of Brazil before the Inter-American System.
