Abstract

This study aims to analyze the euthanasia theme inserted in the
preliminary draft of the Penal Code as a typical and anti-juridical conduct. There are exposed several contrasting points in the doctrine, with the delicacy of the theme involved, when there is a confrontation of understandings concerning the fundamental
rights to life and the autonomy of the will, as aspects of the guiding principle that is human dignity. The deductive method was adopted in order to demonstrate the prematurity of the analysis of the subject by ordinary law, based on theoretical
references published in physical and digital media, concluding on the validity of the hypothesis aligned.
