Abstract

Non-human animals have been a constant presence in human life since the dawn of humanity, being used for both basic purposes such as food and frivolous activities such as sports. The superiority of man was marked for centuries by important thinkers such as Descartes, Kant and Hegel who, considering non-human animals as beings devoid of consciousness, left them at the mercy of beings considered superior. It was only in 1876 that the first law regarding the limits of animal experimentation was created in the United Kingdom. In Brazil, protective guardianship was only observed in 1934. In this context, this study aims to present considerations about tests carried out on non-human animals, based on the legislation in force, more specifically those involving tests carried out both in the research and development of pharmaceuticals and in the cosmetics industry, adopting the deductive method based on legislative, bibliographical and jurisprudential research, with the purpose of identifying the intrinsic values ​​that drive this vigorous discussion and their respective positive and negative points.
