Abstract
The objective of this work is to analyze the need for the permanent search for the protection of the health and life of the worker, with the guarantee of a healthy environment, recognized within the American global and regional systems for the promotion of human rights, according to its International Rights Treaties. Humans, by applying the principle of progressivity and social non-retrogression in the search for the realization of social human rights, with respect for the human dignity of the worker. The importance of recognition by the American regional system, makes it possible for the Inter-American Court of Human Rights to act, which can be used by workers or by union entities to guarantee the effectiveness of the right to a healthy work environment. The methodology used was a bibliographic review with the analysis of international standards and the doctrine on the topic.
