Abstract

 It appears that the issue of the health crisis imposed by the Pandemic of COVID-19, has directly impacted the means of production and inevitably the work environment, generating vulnerability of workers from different segments. In this context, this article aims to discuss the exercise of the right to strike, as a mechanism for preserving the social right to health and work. For this, exploratory, bibliographic, and documentary research on the topic is carried out, so that the collected data are analyzed through deductive and systemic methods. The research resulted in the identification that with all the peculiarities imposed by Pandemic, and the need to maintain economic activity, the employer must guarantee the health of the working environment. From this perspective, it is important to evaluate how the measures adopted, in general, the vulnerability of the worker has increased, and how it is possible, in this context, the preservation of health, through mechanisms that compel the employer to reestablish the health standards in the work environment. Finally, the limits of the discussion will be drawn up, to define whether the right to strike, in the Pandemic scenario, can be a coercion mechanism, which rescues the social right to health and work, especially in the scenario in which the maintenance discourse economic activity, without due care with the preservation of health and the work environment, can put the physical, mental, and social integrity of the worker at risk.
