Abstract
This study promotes an analysis of the nature of the list of procedures of the National Supplementary Health Agency - ANS, on which the majority understanding adopted by the courts is that it is an exemplary list. Recent decisions by the Superior Court of Justice, and the latest normative resolution by ANS itself, started to consider such as an exhaustive list of procedures. For this analysis, the principles and legislation on the interpretation of norms that govern fundamental rights were addressed, in view of the repercussion of the theme on the fundamental right to health, demonstrating the most coherent understanding with the realization of this right.
