Abstract

This article aims to gather, considering the deductive method employed, through bibliographic references, articles, studies, laws, standards and national and international guidelines, data that reinforce the benefits of using the phytotherapeutic compound based on cannabidiol, describe the legal problems that have been developing in Brazil regarding the subject, generating insecurity and difficulty in access by patients, the consequent developments of judicialization, which also have an uncertain outcome due to the conditions imposed and lack of inclusion in the list of the National Supplementary Health Agency (ANS), as well as demonstrate the international view, which clashes head-on with the confused stance that has been adopted in the country. As a conclusive result, it allows a solid reference for the safe prescription of the drug by doctors, if the clinical understanding is that it is the best indication for the case, without conditions, allowing patients access to the right to the best therapy and therapeutic method.
