Abstract

This research consolidates the idea that municipalities can adopt measures to implement the National Policy on Climate Change (Law No. 12,187/2009) through integrated actions by public entities, which are subject to the application of the Federal Constitution and current infra-constitutional legislation in favor of environmental protection as a concurrent duty among federated entities. This is because, as they experience environmental problems more closely, they are better equipped to combat environmental damage that reverberates into climate problems. Thus, the objective was to verify measures correlated to the National Policy on Climate Change only in the coastal area of ​​the State of Bahia, considering, for this purpose, all municipalities that are located on its coast, making the proposed epistemological cut necessary given the continental extension of the Brazilian coastline. In this context, adopting the deductive method, with inclusion of theoretical, normative and empirical research techniques (case studies), supported by references published in physical and digital media, the following result was found: a) nonexistence of municipal laws on climate change in the Bahian municipalities studied; and b) the need to publish these laws. In the end, it was concluded that actions promoted at the municipal level by public entities must be based on the constitutional principle of strict legality, and its adoption is perfectly possible due to the archetype in force in the 1988 Federal Constitution.
