Abstract

Climate change is a reality and deforestation has a major impact on this. In order to meet the environmental commitments made by the European Union, the European Parliament approved Bill 2021/0366, which aims to define prerequisites for certain products to be imported by countries in the economic bloc. The prerequisites include the need to prove that the product was not produced in an area deforested after December 2020, in addition to proving its origin and defining the countries as high, medium or low risk. However, such definitions occasionally conflict with the legislation of exporting countries, especially Brazilian law, which has already been developed and improved over the years. Therefore, the following question arose: what are the necessary requirements for certain products to be imported by the countries that make up the European Union and how does this differ from Brazilian legislation, in addition to impacting the national agribusiness chain? Afterwards, a bibliographic and documentary research was carried out on the subject, analyzing such information using historical, observational and monographic methods, and it was found that the discrepancies between the new European bill and Brazilian legislation could have a significant impact on Brazilian agribusiness. In order to anticipate this situation and prepare Brazilian exporters, a macro analysis of European regulations was carried out. Then, comparing them with the measures already taken by the Brazilian legislator, the problems that will be faced by Brazilian producers and companies, which need to adapt or change the final destination of their products, were observed.
