Abstract

Background: Since the beginning of time immemorial, man has used non-human animals to satisfy his most diverse needs, such as clothing, food, personal protection, transportation and currently as companions, friends, among others. This behavior needs to evolve as society develops, since, for ethical reasons, the use of non-human animals merely as things is not justified. Objective: Based on this perspective, this study seeks to analyze the ability of animals to obtain legal personality in the Brazilian legal system, in particular regarding the law and morals involved in obtaining such personality. Method: Structured through the inductive method, the study was carried out through author-data research and as research sources doctrine, legislation and scientific articles. Conclusion: Furthermore, the concepts of legal personality and its institutes were introduced, presenting at the end the method that the authors present for the realization of personality rights to animals. It also demonstrates that the hypotheses presented were partially confirmed.
