Abstract

Background: Given the violation of rights (ADPF No. 347) in our prison system, this article aims to demonstrate that the APAC Method (Christian-based prison system), as an efficient public penitentiary policy, is capable of significantly minimizing recidivism rates. Objectives: Therefore, it aims to examine the actions that the government has promoted to significantly promote this method, and whether obstacles are encountered in its application and how they can be overcome. Due to its results that are unquestionably more successful than those of the conventional prison system, it was verified what is being proposed so that APAC can become an alternative in the resocialization of the recovering inmate and in his/her avoidance of recidivism. DEPEN - National Penitentiary Department - Based on Resolution No. 3, of September 2019, initiated the “Ressocializa Pilot Project”, which aims to install CRS - Social Reintegration Centers, managed by civil society. The project is still in the experimental phase, however, it demonstrates that the State begins to have a different view of the Apaquean methodology. With this measure adopted, 6 (six) Associations for the Protection and Assistance of Convicts were defined to participate in the “Pilot”. Method: The research was carried out through a questionnaire sent, through the means made available on the government website, regulated by Law No. 12,527, of November 18, 2011 (law that regulates access to information), to the 5 States mentioned in the project (Minas Gerais, Rondônia, Maranhão and Rio Grande do Sul) with 6 simple and objective questions in order to elucidate the progress of the project. Conclusion: It is observed that obstacles related to secularism, the non-delegable functions of the State that in this method become delegable, transfer of funds, among others, delay the effective implementation of the methodology. Conclusion: It is observed, however, that even in the midst of so many challenges, the public authorities have recognized the work carried out through the APACs.
