Abstract

This article aims to provide an overview of the defendant's potential defenses under the new Code of Civil Procedure, highlighting the ways in which they are offered and the issues related to the singularities of each "iter procedural" of each one. By analyzing the defenses, in particular, we seek to fill some gaps, including with regard to decisions and respective appeals, by presenting ideas, sometimes based on principles, sometimes based on analogy. There are many innovations and several adjustments will be necessary for the judicial system and the procedural system to achieve the desired speed, without neglecting the main purpose of jurisdiction: JUSTICE.
